Those accounts should have been filed by 31 March 2020 but they shortened the year by one day to 29 June which meant they got another three months to file them. The accounts they filed actually refer to 30 June as the year end not the 29 June, so are technically incorrect. Also they state in the directors report that they have prepared a financial projection for the next 12 months as at the date of signing off those accounts. I.e at 29 June 2020 when they signed those accounts they state for the public record that they have financial projections available. Why then did they ask the EFL for more time to 31 August to prepare those projections that are required of them by 31st July when they state they already have them available apparently? Have the EFL asked to see these projections now seeing as they have been prepared??

Macclesfield Town Football Club Limited were due to file an annual "confirmation Statement" with Companies House by 14th January 2020. It is still outstanding.
The confirmation statement lists the basic company details like, registered address, list of directors etc and costs £ 13 filing fee.
In response to the question "What happens if you don't file a confirmation statement"? Companies House website states " Failure to file the confirmation statement before the due date is a criminal offence which can result in directors being fined personally in the criminal courts*. In addition, not filing the confirmation statement risks the company being struck off of the register of Companies House".

* You can get an unlimited fine.

Being struck off the register means the company no longer exists.

From a HMRC point of view I know if a company is being considered to be struck off we get informed by Co's House.
This allows us to object which we routinely do if there are outstanding issue including debts.Whether we manage to then collect them is another thing.
Also in certain circumstances even if a Co is struck off an application can be made for them to be restored.
Sev will probably be better than me at the Co law aspect of this.

A company can dissolve itself by completing a form and sending it with 10 pounds to companies house. Perhaps the EFL will lend them the 10 pounds

I'm a personal tax man, so don't know a great deal about companies. But yes you can apply to have it reversed.

Don't know why companies don't submit these confirmation statements on time as they're not exactly difficult to do. Would take 2 minutes to do online if no changes to share capital/shareholdings etc.

But then again the Macclesfield chairman probably doesn't even know about it.

The local Grimsby paper ran a fans vote on who should be relegated and it was much closer than you might think - the paper also supported Stevenage by saying they had played by the rules whereas Macclesfield hadn't.
TBH it was pretty much pro Boro.

Maccelsfield fans on Wrags to Riches are saying that the EFL cannot appeal the independent decision as its binding. They add that if the EFL do not like the plan that Mac have to file in 4 weeks the EFL can remove Maccelsfield.

Seeing the accounts that they have posted unless someone steps into to show they can pay creditors in timely fashion,
Mac are risking expulsion from the League.

After all this I think Maccelsfield will still be a league club. The league has bent over backwards so often they cannot get them selves upright, its called lack of backbone.

I just do not see any way they see out next season (I didn't anyway but this is just further proof) and cannot believe that the FL think they will either. Can see why other L2 clubs want them out, they are going to be ridiculous next season if still in the League (although would mean one less relegation spot for them).

Will be interesting to see how it goes when they have to submit their plan for next season to the FL in July, no way on earth can they satisfy the FL that they are a going concern.

Position will only have got worse.In normal times HMRC would have objected to the last winding up adjournment.
They have to lodge a financial plan by 31/7. This surely must show how they intend to pay these creditors and also meet there running costs next season .
Will not make any difference to us though unless EFL do appeal the independent panel decision.
