EFL obviously hoping Macc don't pay their fine and don't provide a satisfactory financial plan by 31st July - and can then kick them out of the league without having to go through the appeal process!

Surely if EFL are appealing the punishment given by the commission which the financial plan was a part of, then doesn't the need to present that plan get sidelined pending the outcome of the appeal?

Yes.

The appeal commission could uphold the original judgement and punishment but they obviously don't have to.

Any new (greater) punishment would see them potentially relegated/expelled (subject to NL starting, and them having somewhere to play, same as us), but they could still reimpose the requirement as a condition of staying in L2 to be activated only if NL doesn't have a start date that meets with EFL satisfaction.

If that makes sense?

I think so. Ha. I guess my main thinking here is - if the appeal upholds the original judgement and punishment, what would be a new realistic date for Macclesfield to need to present their financial plan and have it approved? Considering we're already going to be into August for this outcome, it's all getting rather late...

Regardless of the appeal I assume they still have to have provided the plan and paid the fine.
The panel can also I assume only uphold the original decision or increase the punishment but not decrease it.
Any further punishment may include new requirements with new deadlines.
Our only hope is added points deduction. If this does not happen even if they go busy before next season it does not help us.

Given the appeal, I'd imagine Macc could (quite rightly) blame the future uncertainty and efforts on the appeal as an excuse not to present this plan.

Why.As far as I know they have nothing more to do .The appeal was made EFL and Macca have already provided their case as part of original decision anyway .They would had ages to prepare this plan BY 31/7.

They actually already have a plan. When they filed their 2019 accounts at Companies House, in the directors report I think they referenced a business plan that showed they were a going concern I think and that report was dated June 2020. So the EFL should ask for site of that plan. Why would they need another one? Unless they want to build in an extra 20k of costs for the fine.

Accounts filed on 29 June. In their policies they explicitly state “the directors have prepared projected financial information for a period of 12 months from the date of approval of those financial statements” Add in another 20k. Job done. Let’s see it then.

Well if Stevenage are to be heard at the appeal, you'd imagine Macclesfield will be given a chance to defend themselves, which they've already said they will do. They also recently blamed the outstanding appeal for 'paralysing the club' until it is resolved.

Per Ollie Baylis twitter s non leagues think they my start 12 or19 Sept . This as long as government gives greenlight for crowds of at least 3rd ground capacity asion whole it will not affect crowds they will have got anyway.Possible from a covid point of view they are hoping for a "relaxed" protocol eg re testing etc.Not sure what that means.

As regards to the fine being a bit silly here but does it matter where they get it from or does the club have to pay it direct which surely they should? If not there then is nothing to stop stop their Supporters Assoc gifting them this ?

Exactly that. It will be a draft make belief fairy tale of how they will plot to win the champions league. We could all write our own version.

I am sure the EFL plan to scrutinise it and pull it apart, however Macc will just say we need more time for due diligence due to COVID-19.

Basically they need to get tough as they did with Bury and if they are not happy then cheerio to Macc.

Looks as though the 1st page of the Business Plan has been written (taken from the Macc Forum)...

No leadership / guidance / direction

• No Board

• No backing / support from the EFL

• No money

No communication

• No team management

• No players (sorry, there were 2 – though they may be on the way once the Transfer Window opens in 10 days time)

• No training facilities – though with only 2 players that’s probably not a pressing issue

• No staff

• No plans for the 2020-21 season - whether that be in EFL2, National League or National North

• No playing kits (or merchandise) - though other Clubs have been announcing kit deals / launches for weeks...

We need to be preparing for League Two. That way our preparation is at a higher level if we go down, and the right level if we stay up.

We5tley would have us preparing for the Championship and we'd be Champions by Christmas, no matter which league we're in.
